I, John Doe, residing at 123 Elm Street, Springfield, IL 62701, being of sound mind, do hereby appoint Mary Johnson, residing at 456 Oak Avenue, Springfield, IL 62701, as the legal guardian and attorney-in-fact for my minor child, Emma Doe, born on May 12, 2015. This appointment is made to allow Mary Johnson to act on behalf of my child for medical, educational, and other necessary decisions when I am unable to provide consent, or when I am absent for any reason.
This Power of Attorney is granted to Mary Johnson for the period from January 10, 2025, until revoked by me in writing, or until Emma reaches the age of majority or as required by law. During this period, my attorney-in-fact shall have the following powers and responsibilities:
Medical Decisions
- Emergency Medical Treatment: Mary Johnson shall have the authority to make decisions regarding emergency medical treatments, procedures, and necessary healthcare for Emma in situations where I am unable to be contacted or provide consent. This includes, but is not limited to, the ability to authorize surgeries, medical tests, and hospital stays that may be required for the well-being of my child.
- Routine Medical Care: Mary Johnson is authorized to schedule and attend routine medical check-ups, vaccinations, and any other non-emergency medical treatments that are necessary for my child’s health. She may also manage any ongoing health conditions that require treatment.
- Mental Health Decisions: Mary Johnson is authorized to make decisions regarding Emma’s mental health care, including seeking professional counseling, therapy, or other psychiatric services, should the need arise.
Educational Decisions
- School Enrollment and Activities: Mary Johnson is granted the authority to enroll Emma in appropriate schools or educational programs and to make decisions related to her schooling, including selecting school courses, extracurricular activities, and special programs. She is also authorized to sign any necessary consent forms related to these activities.
- School Conferences and Reports: Mary Johnson may attend parent-teacher conferences, meetings, or hearings regarding Emma’s education and academic performance. She is also authorized to receive and review Emma’s school records and reports.
- Special Educational Needs: If necessary, Mary Johnson may request and authorize special educational services, including assessments and modifications, if Emma requires support due to learning disabilities or other conditions.
Personal and Legal Decisions
- Travel Authorization: Mary Johnson is authorized to make decisions regarding travel and may take Emma on trips, both domestically and internationally, when it is deemed appropriate and in Emma’s best interest. She may also handle matters related to passports, visas, or travel consent forms if necessary.
- Legal and Governmental Affairs: Mary Johnson is granted the authority to manage any legal or governmental matters on behalf of Emma, including applying for government benefits or assistance programs, signing legal documents on her behalf, or dealing with legal matters related to her welfare.
Custody and Guardianship
This Power of Attorney grants Mary Johnson the authority to act on Emma’s behalf for the above-mentioned matters during my absence, but it does not grant Mary Johnson permanent custody or legal guardianship of Emma. Any permanent changes to Emma’s legal guardianship will require additional documentation or legal action that is separate from this Power of Attorney.
This Power of Attorney will automatically become effective on January 10, 2025, and shall remain in effect until I revoke it in writing or until Emma reaches the age of majority, whichever comes first. In the event that I revoke this Power of Attorney, the revocation will be effective immediately upon the delivery of written notice to Mary Johnson, and she will no longer have any authority to act on behalf of Emma.
I affirm that I am providing this Power of Attorney to ensure the well-being, safety, and continued care of my child in situations where I am unavailable to act on her behalf. I trust that Mary Johnson will exercise the powers granted in this document with the utmost care and consideration for Emma’s best interests.
This Power of Attorney is granted voluntarily and is intended to be used in a manner consistent with the wishes of both Emma and myself. If any part of this document is found to be invalid or unenforceable, the remaining provisions shall continue to be valid.
